A’Court overrules High Court, sacks Ned Nwoko as PDP senator-elect, returns Nwaoboshi

The Court of Appeal in Abuja on Thursday dismissed a Federal High Court judgement that sacked Senator Peter Nwaoboshi as the candidate of the Peoples Democratic Party (PDP) for Delta North Senatorial seat.

The Court held that the lower court had no jurisdiction to hear the matter and any judgement arising from there was null and void.

Justice Ahmed Mohammed of the High court had on April 3, 2019 given the judgment in a suit filed by Ned Nwoko, ordering the Independent National Electoral Commission (INEC) to accept Nwoko as the party’s candidate.

But in a unanimous judgment on Thursday, a three-man panel of the Court of Appeal, held that the Federal High Court had no jurisdiction to have heard the case filed by Nwoko.

Justice Mohammed Idris, who gave the lead judgment, held that the suit by Nwoko was statute barred and that Justice Ahmed Mohammed of the Federal High Court, Abuja ought not to have heard the case and gave the judgment he gave in favour of Nwoko.
