A’Court strikes out Saraki’s motion after counsel withdraws it

The application filed by Senate President, Bukola Saraki, before the Abuja Division of the Court of Appeal, asking for a stay of proceeding in his trial at the Code of Conduct Tribunal, CCT, has been struck out.

The appellate court’s panel of Justices, led by Justice Abdul Aboki, struck out the application after it was withdrawn by Chief Kanu Agabi, Saraki’s lead counsel.

Agabi however prayed the court to accelerate the hearing of the substantive appeal challenging the jurisdiction of the CCT to entertain the 13-count criminal charge the federal government instituted against his client, while also apologizing to the court for the decision to withdraw the application.

“We sincerely apologise to your lordships for taking the action after you have already read through such a voluminous motion. It is unfair to say we are withdrawing. But we have to. We want to withdraw the motion”, Agabi submitted.

The court is yet to fix a date for the hearing of the main appeal.
