Adegboruwa goes from anti to pro Magu, withdraws suit against EFCC boss

Lagos lawyer and rights activist, Mr Ebun-Olu Adegboruwa, has changed his mind from opposing to supporting the positing of the Economic and Financial Crimes Commission’s (EFCC’s) acting chairman, Ibrahim Magu.

The lawyer on Monday, asked a Federal High Court siting in Lagos and presided over by Justice Mojisola Olatoregun, to strike out his suit filed before the court challenging the position of Magu as EFCC acting chairman.

Adegboruwa had filed a suit asking for an order to restrain Magu from holding the chairmanship position of EFCC in an acting capacity.

He had traced Magu’s appointment back to November 9, 2015 and contended that he had been functioning in an acting capacity as EFCC chairman more than the six months allowed by law.

He described Magu’s continuation as EFCC acting chairman after Senate refusal to confirm him as substantive chairman of the EFCC as illegal.

He buttressed his argument by citing the provisions of Section 2 (3) of the EFCC Act, which made the confirmation by the senate a condition precedent to the appointment of an EFCC chairman.

Among other arguments, the lawyer asked the court to restrain the EFCC and all other authorities from recognising, treating or in any other manner, dealing with Magu as the chairman of EFCC, either in acting or substantive capacity.

The defendants in the suit were the Senate, the attorney-general of the federation, the EFCC and Magu.

However, when the case was called up in court on Monday for hearing, Adegboruwa decided to withdraw it, this left the presiding judge, Justice Olatoregun with no other option than struck out the suit.

Mr. Tayo Oyetibo (SAN), counsel to Adegboruwa, addressing the court on the matter said his client had decided to discontinue the case.

“There is need to give Magu the opportunity to continue the anti-corruption campaign of the present administration and since this case may affect his confirmation, it is better to discontinue it,” Adegboruwa’s counsel told the court.

Adegboruwa highlighted the position of his lawyer by saying that he was convinced by his counsel to withdraw the suit because Magu would do a good job in his approach to the anti-corruption drive of the present administration.

    Could I say magu has bribed this lawyer or I should say the lawyer just got delivered from his insanity? This is a serious matter, but well, what will be concerning magu will be.

      Magu has championed the course of being the efcc chairman and there is nothing any can do about that.
      His enemies must turn up to be his friends now.

        Yes but don’t forget the evil that men do live with them and also follow them to there early grave? Don’t forget magu may be the chairman of efcc but not a good one to behold the set

    I think this man was under some cheap drugs. He wouldn’t have withdrawn the case in his right human senses. The court was supposed to take him for mental check ups before accepting what he requested.

    Magu deserves to get the best from everyone in this country, he has proven himself worthy and gave his best to serve as EFCC acting boss, it is important the senate credits his hard works by confirming his nomination as EFCC chairman

      As long baba buhari wants him there, then no opposition can stop him from being the chairman of the efcc.
