Bayelsa APC free to adopt direct governorship primary, court rules

The Bayelsa High Court sitting in Yenagoa on Tuesday set aside an interim order preventing the All Progresives Congress (APC) from using direct method for its governorship primaries in the state.

The court presided by Justice E.G. Umukoro, held that the interim order which was initially granted could no longer stand.

Reviewing the interim order against the position of the respondent, Umukoro said the kernel of the application was that the interim order was made without jurisdiction and was at variance with the electoral act, constitutions of the APC and the country.

“The jurisdiction was for the party to decide on the mode that would suit the party members,” he said.

He, therefore, asked the APC to go ahead to decide the method that would suit members of the party.

The APC had been forced to postpone its primaries on two occasions due to the lingering court case.
