Court differs judgement on Evans suit as Police, IGP deny being part of suit

Ruling on the N300 million Fundamental Rights Enforcement suit instituted before a Lagos Federal High Court by suspected kidnapper, Chukwudumeme Onwuamadike, also known as Evans, was on Monday deferred.

The court took the move as the police and the Inspector General of Police (IGP) denied being part of the proceedings.

Evans had in the suit dragged the Inspector General of Police, and three others before a Federal High Court in Lagos over his alleged illegal detention.

He is claiming N300 million as general and exemplary damages against the police for alleged illegal detention and unconstitutional media trial.

Joined with the IGP in the case were Nigeria Police Force, the Commissioner of Police Lagos State and the Special Anti-Robbery Squad, Lagos State Police Command.

However, when the case came up in court on Tuesday, the police denied that neither the Inspector General of Police nor the Nigerian Police Force had been party to the proceedings.

Base on the position of the police, the court failed to go ahead with judgment since it could not hear from both parties.

The presiding judge, Justice Abdulaziz Anka, therefore adjourned the case till September 5, 2017.

The court had earlier dismissed all the objections to the hearing of the Fundamental Rights Enforcement Suit and fixed August 29 to deliver judgment on the matter.
