PDP members protest over alleged dissolution of election tribunal

October 31 has been slated for the arraignment of Senator Ademola Adeleke in court over alleged examination malpractice.

A Federal High Court in Abuja on Monday, ordered the Inspector-General of Police, Mr. Ibrahim Idris, to ensure that Adeleke, who was the Peoples Democratic Party’s (PDP’s) governorship candidate in the recent governorship election in Osun State and four others were araigned in court on the fixed date.

The order was given by Justice I.E. Ekwo, during a brief hearing, on examination malpractice charges leveled on Adeleke and the others.

The hearing was however stalled owing to Adeleke’s absence on Monday.

Consequently, the judge directed the IGP to ensure all the five defendants were brought to court for arraignment on October 31.

“The prosecution is ordered to ensure the defendants are in court at the next date , to take their plea,” the judge ruled.

The IGP had on September 19, 2018 through the prosecuting counsel, Mr. Simon Lough, filed four counts of examination malpractices against Adeleke and his four co-accused.

Lough had informed the judge on Monday that the matter marked, FHC / ABJ /CR / 156 / 2018, was coming up for the first time on Monday.

The prosecution is alleging that the five defendants committed examination malpractices by fraudulently, through personation, registering Adeleke and another Sikiru Adeleke, as students of Ojo-Aro Community Grammar School, in Ojo-Aro in Osun State, for the National Examination Council’ s June/ July 2017 Senior School Certificate Examination in February 2017.

Aside Adeleke other defendants in the matter are Sikiru Adeleke, the principal of Ojo- Aro Community Grammar School; Alhaji Aregbesola Muftau, the registrar of the school; Gbadamosi Ojo, and a teacher in the school, Dare Samuel Olutope.

Only Adeleke was absent the in court on Monday, but his counsel, Dr. Alex Izinyon (SAN ), told the judge that he was not in court because of ill health.

Submitting a medical report to prove his claim, he pleaded with the court to grant a short adjournment to enable the first defendant to recover.

The prosecuting counsel, Lough, acknowledged that the medical report had been served on him and urged the court to grant a short adjournment.

Adeleke is currently challenging his defeat by Adegboyega Oyetola, the All Progressives Congress’ (APC’s) candidate in the Osun State governorship election at the election petition tribunal.
