FG amends charges against Sen Misau

Senator Isah Misau has again been dragged before the Federal High Court in Abuja by the Federal Government with amended charges bordering on making and “uttering” false documents.

The amended charges which have three additional counts as against the earlier one with seven counts was signed by Mr. Kayode Alilu of the Office of the Attorney General of the Federation and filed on October 27, 2017.

The case marked FHC/ABJ/CR/170/2017 has been assigned to Justice Anwuli Chikere, and has been fixed for November 7 for hearing.
The amended charges differs from the case the Federal Government leveled against Misau before the High Court of the Federal Capital Territory in Abuja, where he was accused of five counts of spreading injurious falsehood against the Inspector-General of Police, Mr. Ibrahim Idris, in the media.

Misau, representing Bauchi Central senatorial district, in the amended charges is alleged to have made and uttered false documents and allegedly submitted same to the Independent National Electoral Commission (INEC) in 2011 and 2014, when he was seeking election to the Senate.

Senator Misau was said to have falsely made and uttered documents as affidavits in support of personal particulars, statutory declaration of age deposed to at the FCT High Court and the Bauchi State Health Management Board Birth Certificate with number 28799.

However, in two of the three additional counts, the Federal Government alleged that he made and uttered a Bauchi State Health Management Board Birth Certificate with number 141400C and submitted same to INEC on January 28, 2011, knowing it to be false.

While he was alleged in the first set of counts of uttering Statutory Declaration of Age deposed to at the High Court of the Federal Capital Territory, Abuja on December 15, 2014, he was nonetheless not charged with the actual offence of falsely making the document.
But in the amended charges, the count of falsely making the document was included.

The senator’s birth certificates and statutory declarations of age submitted to INEC at different periods according to the prosecutor, have conflicting dates.

This came as Misau was earlier on October 19, arraigned before the High Court of the Federal Capital Territory in Maitama, Abuja, by the AGF office on five counts of making injurious falsehood against the Nigeria Police Force and the IGP.

Among the allegations by Misau which government considered as injurious to the IGP and the NPF was the claim by Misau that police officers allegedly paid as much as N2.5 million to get special promotion and posting through the Police Service Commission (PSC).

Also is the claim by the lawmaker of IGP’s alleged act of diverting money meant for the purchase of Armoured Personnel Carriers, Sport Utility Vehicles and other exotic cars as well as IGPs posting of almost half of his Nupe people as mobile commanders in the country.
