Gov Ayade wins as Tribunal throws out all APC complaints

Governor of Criss River State, Ben Ayade on Thursday, had his governorship election affirmed by the election petition tribunal sitting in the state.

The tribunal led by its chairman, Justice Josiah Majebi dismissed all the pleas of Senator John Owan-Enoh, candidate of the All Progressives Congress (APC) in that election.

According to Justice Majebi, the petition number EPT/CAL/GOV/01/2019 was a pre-election matter and the tribunal lacked jurisdiction to entertain it.

The victory earned by Governor Ben Ayade during the March 9, 2019 governorship election in Cross River State, has been upheld by the governorship election petition tribunal, which sat in Cross River State on Thursday.

The affirmation of the victory of Ayade, the governorship candidate of the Peoples Democratic Party (PDP), came about when the Chairman of the three-man tribunal, Justice Josiah Majebi dismissed all the pleas by the petitioner.

While reading the judgement, Justice Majebi said the petition with number EPT/CAL/GOV/01/2019, which was filed by Senator John Owan-Enoh of the All Peoples Congress (APC) was a pre-election matter and the tribunal lacked jurisdiction to entertain it.

“The petition failed and is accordingly dismissed. We hereby find that Prof Ben Ayade is duly elected as Governor of Cross River State in the March 9, 2019 governorship election,” Justice Majebi said after dismissing all the prayers of the petitioner.

Justice Majebi further stated that; “The petitioner failed to establish the burden of proof that he was excluded from contesting the governorship election,” adding that the petitioner contested and scored some votes in the election and so he could not have been excluded, saying such grounds were “irreconcilable and diametrically opposed to each other.”
