S’Court postpones Patience Jonathan’s hope of reclaiming assets seized by EFCC

Former first lady, Patience Jonathan has been ordered to forfeit $8.4 million to the Federal Government.

The Supreme Court in a unanimous judgement on Friday affirmed the decision of the Federal High Court that ordered the interim forfeiture of the sum of money.

The five-man bench of the apex court led by Justice Dattijo Muhammad, directed the former first lady to the lower court to prove to the court reasons why she should not forfeit the funds to the government permanently.

She had prayed the Supreme Court to strike down the provisions of section 17 of the Advanced Fee Fraud Act and other Fraud related offences Act, which was relied on by the Federal High Court to issue the order of interim forfeiture.

The request was, however, rejected.

The Economic and Financial Crimes Commission (EFCC) last year obtained an ex parte order from the Federal High Court in Lagos seeking the forfeiture of the sum of $8,435,788.84 and other various sums in various bank accounts allegedly linked to the former first lady.
