Justice Abang refuses Kashamu`s application to stop his extradition to U.S.

A Federal High Court in Abuja presided over by Justice Okon Abang, has refused to rule on an application by Senator Buruji Kashamu, to stop his extraditing to the United States (U.S.) to face corruption charges.

Senator Kashamu had through his council, Mr Godswill Mrakpo on Tuesday, sought court order to restrain all the respondents and their agents from arresting and detaining him, as well as stopping the Department of State Services (DSS), from extraditing him to the U.S to face charges.

But the presiding judge, Justice Abang, refused the application. He instead, ordered that the DSS and others, who are third respondent, should be served outside jurisdiction of the court.

He then directed the applicant to file and serve the motion on notice on DSS, Inspector-General of Police and Mr Oladikupo Adebutu.

“It is my view that the court should give the respondents opportunity to show cause why restraining order should not be granted against them.

“The court shall give them time to respond, I want to hear from the respondents,’’ Abang said.

He also refuted another prayer seeking to serve the respondents through a substituted means, arguing that the applicant did not place any material before the court to show he made any effort to serve the respondents which did not yielded any result.

Abang therefore struck out the first and second reliefs sought by the applicant.

Abang adjourned hearing in the suit till September 8, to enable the applicant to serve all the respondents with motion on notice.
