KOGI: State judiciary asks court to nullify assembly's resolution

The Kogi State Judiciary has begun a fight back over the resolution of the state House of Assembly recommending the sack of the Chief Justice of the state, Justice Nasir Ajanah, by approaching the state High Court sitting in Koton-Karfe, seeking the nullification of the resolution.

The state House of Assembly had in April 2 passed a resolution recommending the sack of the Chief Judge and the misconduct. The lawmakers also recommended that the state Judicial Service Commission should discipline the Chief Registrar also for misconduct.

Chief Adegboyega Awomolo, SAN, led 11 other lawyers to file the motion against the resolution of behalf of the claimants/applicants, Justice Ajanah and the Chief Registrar, Yahaya Adamu.

The Kogi State House of Assembly, the Speaker, the Chairman, House Ad Hoc Committee; Kogi State Governor and the Attorney General of Kogi State were joined as respondents.

According to th plaintiffs the lawmakers’ decision to remove the CJ was made contrary to a suit and an interim order made by the court and therefore prayed for an order nullifying the resolution.
