Man jailed for having consensual s*x without condom

A 45-year-old Frenchman who had carnal knowledge with a s*x partner who believed he was wearing a condom but actually did not, has been convicted of rape by a Swiss court.

The landmark decision which is regarded as the first of its kind in Switzerland rules that the suspect will spend 12-month in jail after the court in Lausanne determined that having s*x without a condom if the use of a condom is expected by those involved is considered rape.

Reports say the Frenchman and the Swiss woman both met via a dating app called Tinder and according to reports they began making love to each other on their second date with a condom, but the man later removed it.

According to the woman, she only realised the man was not wearing a condom when the session was over and according to the court judge, if the woman had known that her partner wasn’t wearing a condom, she would have refused s*x with him.

Speaking to ATS on Tuesday, the victim’s lawyer said the decision was “a first for Switzerland.”
