METUH: Court throws out Jonathan's application, as Dasuki mounts witness box

The Federal High Court in Abuja has thrown out the applications of former President Goodluck Jonathan and the detained former National Security Adviser, Sambo Dasuki, against the subpoenas compelling them to appear before the court.

The court had sequel to the prayer of a former National Publicity Secretary, Olisa Metuh, ordered that the subpoenas be issued to both Jonathan and Dasuki to come and testify in the alleged N400 milion corruption trail leveled against Metuh by the Economic and Financial Crimes Commission (EFCC).

However, both Jonathan and Dasuki had filed separate applications seeking the court to set aside the subpoena order.

But ruling on the application, the trial judge, Justice Okon Abang, held that he had no jurisdiction to entertain Jonathan’s application since the former president was yet to be served with the subpoena directing him to appear in court.

On the prayer of Dasuki for an adjournment of the case pending the determination of his motion against the subpoena before the Court of Appeal, Abang held that granting the prayer would amount to flouting the earlier judgment of the ‎Court of Appeal delivered on September 29, directing him to sign and ensure the execution of the subpoena on Dasuki.

Upon dismissing the application, Justice Abang, ordered Dasuki to enter the witness box.

Dasuki was in the court for the first time on Wednesday after so much pressure was mounted on Department of State Service (DSS) to produce him in court to testify in Metuh’s trial.

The EFCC is prosecuting Metuh and his company, Destra Investments Limited for alleged fraud in receiving about N400 million from the office of the NSA while Dasuki held that office under the administration of former President Goodluck Jonathan.
