Metuh wants Jonathan called as witness in alleged fraud case

The former publicity secretary of the Peoples Democratic Party (PDP) Olisa Metuh, on Monday told the Federal High Court in Abuja that he has written former President Goodluck Jonathan to come and testify in his ongoing alleged fraud trial but that the former president was yet to reply.

He went further to tell the court presided over by Justice Okon Abang, through his lawyer, Onyechi Ikpeazu (SAN) that he has the intention to apply for subpoena to be issued on Jonathan so that he can appear as witness in the ongoing trial.

He said he would want the former president to witness in the matter after the former National Security Adviser (NSA), Sambo Dasuki, who had been in the custody of the State Security Service (DSS), but earlier summoned to testify as witness in the case has ended his testimony.

Metuh’s lawyer said, “We have another witness on subpoena, and at the end of the evidence of this, another witness, we will take a decision on whether or not the first defendant (Metuh) will testify.

“The other witness we want to subpoena is Goodluck Jonathan, former President of the Federal Republic of Nigeria.”
Making his argument clearer Ikpeazu told the trial judge, “We wrote him (Jonathan) a letter but he did not respond and our plan will be to apply for the subpoena after the first application (for subpoena to be issued on Dasuki).”
Dasuki, who Ikpeazu said was slated to testify for the defence on Monday, was absent and could not testify on Monday.

Meanwhile, counsel to Dasuki, Ahmed Raji (SAN), who was in court, opposed the request to compel the ex-NSA to testify as Metuh’s defence witness.

Recall that the Court of Appeal had in Abuja on September 29, ordered DSS to make Dasuki available before the court so that he can testify as Metuh’s witness.

The appellant court had in a unanimous decision delivered by its three-man panel, ordered Justice Abang, who is presiding over Metuh’s case, to without any delay sign the subpoena filed by Metuh and serve same on Dasuki.

In the judgment which was prepared and read by Justice Peter Ige, and agreed by the other panel members of the Court of Appeal, Justices Emmanuel Agim and Mohammed Mustapha, he had asked Justice Abang to indicate the date which the DSS must produce Dasuki in court and other subsequent dates when the ex-NSA’s court attendance would be needed.

Metuh and his company, Destra Investments Limited, are being prosecuted by the Economic and Financial Crimes Commission (EFCC) on seven counts of money laundering which has to do with alleged cash transaction of $2 million and fraudulent receipt of N400 million meant for purchase of arms from the NSA office on November 22, 2014.
