ONDO GUBER: Hope for Jegede as A’Court grants his application

Ondo State governorship candidate of the Ahmed Makarfi-led Peoples Democratic Party (PDP) Eyitayo Jegede (SAN), can now appeal against the ruling of Justice Okon Abang which led to Jimoh Ibrahim replacing him as the party candidate.

This is as the special panel of the Appeal Court sitting on the PDP governorship candidate tussle on Thursday granted Eyitayo’s application to appeal the Justice Abang’s judgement which the Independent National Electoral Commission (INEC) gave as reason, it substituted Jegede’s name with that of Ibrahim of the Sheriff-led faction.

The panel at the sitting also dismissed the application of ousted PDP factional Chairman, Biyi Poroye challenging its jurisdiction and asking for its disbandment.

Justice Ibrahim Salauwa, in his lead ruing stated that the application of Jegede is of merit having critically observed the grounds of appeal and supporting affidavits as well as counters from the other parties.

According to Justice Salauwa, Jegede obviously established with copious evidence that he was affected by the ruling though not a party to the suit, having successfully gone through a primaries in Akure.

On the other hand, he said Poroye’s application has no merit and was thereby dismissed. Two other justices on the panel, Ignatius Agube and George Baba concorded with justice Salauwa that the application is “absurd, blackmail, utmost mischief, abuse of court process aimed at annoying the appellant and obstructing justice.”

The justices of the Appeal Court went further to note that it is a misnomer for the Appeal Court President to consult with parties before setting up any panel which would undermine his administrative powers as enshrined in the constitution.
