PDP CONVENTION: A’Court quashes hope of Kashamu faction to represent S’West

The hope of Chief Makanjuola Ogundipe’s led executive to represent the Southwest zone at the December 9 national convention of the Peoples Democratic Party (PDP) on Monday suffered a set back.

The Appeal Court sitting in Ado Ekiti ordered a stay of execution of the ruling of the Federal High Court that declared the faction, also supported by Senator Buruji Kashamu, as the authentic zonal leadership of the party.

Following the ruling, a stop has finally been put to the issue of which executive faction between the Ogundipe and Dr. Eddy Olafeso, will represent the Southwest zone in the December 9 national convention of the PDP.

The Federal High Court in Ado Ekiti, presided over by Justice Taiwo Taiwo had in an earlier judgment restrained the Dr. Eddy Olafeso led South-west zonal executive from functioning as the authentic leaders of the PDP in the zone.

Olafeso had approached the appellant court challenging the ruling of the lower court and had sought for an order staying the execution of the judgement of the lower court that sacked his faction.

The Appeal Court sitting on the matter on Monday granted the interim order staying execution of all orders granted by Justice Taiwo.

It also stopped all proceedings at the Federal High Court, Ado Ekiti pending the determination of the appeal and frowned at the a letter dated November 30, 2017 and addressed to the presiding Justice of the Court of Appeal, Ado Ekiti Division, by Ogundipe, seeking a postponement of the hearing of the motion for a stay of execution brought by the Olafeso.

It held that Ogundipe’s letter was an attempt to intimidate the court and that “We refuse to be intimidated by the first respondent (Ogundipe).”

In granting the application for stay of execution of the Justice Taiwo orders, the appeal court, presided over by Justice Ahmad Belgore took cognizance of the pending application to commit Olafeso and others to prison for contempt scheduled to be heard on Tuesday at the Federal High Court, Ado Ekiti.

He said, “All the orders and rulings of the lower court delivered on October 17, October 23 November 8 and November 27, 2017 have been stayed in the interim, meaning that those orders and rulings are of no value as from now and cannot be used anywhere having been rendered null and void, and that all the proceedings at the Federal High Court have been stayed pending the determination of the interlocutory appeal that is before the Appeal court.”

Further hearing on the appeal was adjourned till January 15, 2018.
