Again, suit seeking to declare Buhari medically unfit hits court

A fresh suit which seeks to have President Muhammadu Buhari pronounced unfit to continue as Nigeria’s leader has been filed before the Federal High Court in Abuja.

The suit, which is the third of such kind, is asking for an order of the court mandating the Federal Executive Council (FEC) to pronounce ailing President Buhari unfit to rule on medical grounds.

It is also asking the court to order the National Assembly to constitute a medical panel to verify Buhari’s fitness.

The suit was filed on Thursday by the incorporated trustees of a civil society group, Kingdom Human Rights Foundation International, and marked FHC/ABJ/CS/671/2017.

Joined as respondents are the Acting President Yemi Osinbajo, FEC, the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami (SAN), and the National Assembly.

Recall that a Nigerian based in the United States of America, Mr. Toyin Dawodu, had through his counsel, Mr Frank Tietie, also recently filed a similar suit marked FHC/ABJ/CS/508/2017.
Dawodu is also praying the court to compel Senate President Saraki to constitute a medical panel on the health status of Buhari.

Besides Dauda, there is yet another suit on the same subject filed by a lawyer and medical practitioner, John Larry Ojukoko and Dr Ejiro Imuere respectively.

The suit reportedly filed at a Federal High Court in Warri, Delta State, like others, is praying for an order of mandamus compelling Senate President Bukola Saraki, and Speaker of the House of Representatives, Yakubu Dogara, to set up a medical panel to ascertain the health of President Muhammadu Buhari, and impeach him if he is deemed unfit.

It is now getting to three months since Buhari returned to London for a follow-up medical treatment for a yet-to-be-disclosed ailment, having earlier spent almost two months in his first medical trip to London, amid growing calls for transparency and accountability on his health.

He has also not been publicly seen, and unheard from directly the whole time, even as the Ekiti State governor, Ayo Fayose maintains a claim that the president has been on a life support machine for some time.
