The battle between two Peoples Democratic Party (PDP) members over who is the authentic senator representing Kogi East senatorial district has been rested as the Court of Appeal sitting in Abuja on Monday declared the seat vacant.

After a rerun election conducted on July 24, 2017, Attai Aidoko and Isaac Alfa, both PDP members, have been locked in a serious legal battle.

Earlier judgment on the pre-election matter had seen the appeal court declared Aidoko the authentic senator of the district.

However, delivering judgment in the matter on Monday, Justice Abdul Aboki of the Court of Appeal sitting in Abuja held that the earlier judgment of the Court of Appeal which favoured Senator Aidoko was in error, hence the need for the nullification.

The All Progressives Congress (APC) did not take part in the election, due to a court ruling.
