Fresh Court ruling resurrects Kano Emirate dispute
The Court of Appeal in Abuja, on Friday, delivered a decision that has set the stage for a fresh hearing in the long-standing legal battle between two of Kano’s most influential traditional figures—Ado Bayero, the Emir of Kano, and Mohammed Sanusi, the former Emir of Kano.
The appellate court’s decision not only casts doubt on the validity of the previous judgment but also sends ripples through the fabric of Kano’s political and traditional leadership.
The three-member panel, headed by Justice Mohammed Mustapha, declared that the original judgment by the Kano High Court, which was delivered on July 15, 2024, was a nullity.
The court’s reasoning centered on a critical issue: the violation of Bayero’s right to a fair hearing. The ruling made it clear that Bayero had been deprived of the opportunity to present his case due to the procedural mishandling by the lower court. The lack of a proper hearing notice and the failure to ensure Bayero’s legal representation led the appellate court to conclude that justice had not been served.
Justice Mustapha underscored the importance of fairness in the judicial process, asserting that all courts, regardless of their jurisdiction, must guarantee that both parties are given equal opportunities to be heard. The ruling also pointed out that Sanusi, like Bayero, had not been properly notified before judgment was passed, making the entire process a “travesty of justice.”

The ruling is not merely a legal victory for the individuals involved—it holds profound implications for the entire Kano Emirate, one of Nigeria’s most politically influential and culturally significant regions. For years, the Kano Emirate has been a source of power, with the reigning Emir wielding considerable influence not just over local affairs but also within Nigeria’s broader political arena.
At the heart of this dispute is the power struggle between two of Kano’s most prominent royal figures, which has reverberated across the Emirate. Ado Bayero, the current Emir, and Mohammed Sanusi, his former predecessor, have long been at odds. Their rivalry has not only divided the royal family but also exposed deep fissures within the political and social fabric of Kano.
This latest court ruling, which effectively invalidates the prior court proceedings, introduces new uncertainties into the already volatile power dynamics within the Emirate. With the case being sent back for a fresh hearing, both sides of the conflict—Bayero’s supporters and those who once rallied behind Sanusi—will be watching closely. The question now is how this prolonged legal battle will affect the cohesion of the Kano Emirate, particularly in the context of the influence these two figures wield.
The outcome of this case is poised to have far-reaching political consequences, not only for the Emirate but for the broader political landscape of Kano State. The Emir of Kano plays a crucial role in local politics, often influencing governance, policy, and even election outcomes. Therefore, the ongoing dispute between Bayero and Sanusi has been closely tied to the political fortunes of their respective factions.
Bayero’s supporters, including powerful politicians and traditional rulers, will be hoping for a swift resolution that confirms his authority as the rightful Emir. On the other hand, Sanusi’s supporters, who view him as a symbol of reform and modernity, may seize this moment to further their cause, especially if the new hearing brings to light any procedural flaws that could benefit Sanusi’s camp.
The appellate court’s decision to send the case back to the Kano High Court for reassignment and expeditious determination places this legal battle back in the spotlight. Both parties now find themselves in a race against time, with the future of Kano’s traditional leadership hanging in the balance.
Bayero’s camp is likely to push for a quick resolution, hoping to solidify their hold on power, while Sanusi’s supporters will be watching to see if the case can be used to challenge the legitimacy of the current Emir.
