Supreme Court dismisses Smart Adeyemi’s appeal on Kogi APC governorship primary

The Supreme Court on Monday dismissed an appeal filed by the former Senator representing Kogi West against the outcome of the All Progressives Congress (APC) governorship primary in the state.

Adeyemi had appealed the verdicts of the Federal High Court, Abuja, and Court of Appeal, Abuja, which upheld Usman Ododo’s victory in the April 15 primary election held in the state.

The ex-lawmaker had challenged the outcome of the exercise over widespread irregularities.

In the applications filed in the lower courts, Adeyemi described the election as a charade and asked the panels to nullify Ododo’s victory in the exercise.

The two courts dismissed the suit for lack of merit.

Dissatisfied with the outcomes, the aggrieved governorship aspirant approached the Supreme Court to set the judgements.

In a unanimous verdict, the apex court dismissed the appeal for lack of merit.

The Supreme Court declared that Adeyemi failed to challenge the concurrent findings of the lower courts or demonstrate that the same were perverse in his appeal.

The panel held that the two issues raised by the ex-lawmaker in his brief were unreasonable, vexatious, and against the provisions of Sections 132 and 133(1) of the Evidence Act 2011.
