Two years after, Appeal Court nullifies Nyako’s impeachment

Almost two years after he was booted out of office, the Yola Division of the Court of Appeal on Thursday nullified the impeachment of former Gov. Murtala Nyako of Adamawa State, declaring it as unconstitutional, null and void.

It would be recalled that the Adamawa State House of Assembly impeached Nyako on the 16 July, 2014 over what was termed as gross misconduct.

The court, in a unanimous judgment by the five justices of the Court of Appeal, said the impeachment was not done in accordance with the provisions of the law as the governor was not served the impeachment notice personally.

In the lead judgment by Justice Tunde Ayotoye, the judges ruled that Nyako was not given fair hearing in the impeachment process.

The court thereafter ordered that Nyako should be given all rights of the Office of the Governor of Adamawa State through the period and paid all his entitlements as governor while it lasted.

Nyako had prayed that he be returned as governor of the state as his tenure had not run out before his impeachment.

But the court denied him this prayer, stating that the period of his tenure has passed.
