Again, court grants former NSA Dasuki bail

Sambo Dasuki and Nigeria’s Subtle Descent into Anarchy

Former National Security Adviser (NSA) Sambo Dasuki was on Monday granted bail in the sum of N200 million and two sureties in like sum by Justice Ijeoma Ojukwu.

Justice Ojukwu said the sureties must be civil servants of grade level 16 and above who possess evidence of their last civil service promotion, which will be given to the court registrar.

Where sureties were private persons, they are to pay same amount and that a deposit of 100million will be made to the account of the court.

The judge also ruled that the sureties must be owners of landed properties in Abuja and must deposit original documents of land title to the court.

She ruled that Dasuki’s international passport should remain with the court.

In her ruling she stated that the detention of Dasuki without trial was a violation of human rights as provided by the constitution.

According to the trial judge, the argument by the Federal Government that Dasuki has remained in custody because of his alleged threat to national security and ongoing investigation for money laundering, was wrong and should not have warranted “abrogating his right”.

Justice Ojukwu said that the Department of State Security (DSS) should have instead chosen to invite and interview Dasuki between the hours of 9am and 6pm on working days if need be, than violating his human rights.

The judgment came after the judge rejected Dasuki’s prayer for N5 billion damages.

The former NSA, who served under former President Goodluck Jonathan, has been in detention for over two years despite being granted bail by different courts.

After the Economic Community of West African States (ECOWAS) Court of Justice on October 4, 2016, ordered his release from illegal detention; a judgment the DSS failed to obey, other court judgments granting Dasuki bail had also been rendered ineffective due to amended charges by the Federal Government.
