Court of Appeal sacks David Mark

The Court of Appeal sitting in Makurdi, Saturday, nullified the election of former Senate president, David Mark, ordering a re-run of the Benue South Senatorial District election within 90 days.

The candidate of the All Progressives Congress (APC) Mr Daniel Onjeh had challenged the decision of the Benue State National and State Assembly Election Petitions Tribunal, which upheld the victory of Senator Mark of the Peoples Democratic Party (PDP), urging the appellate court through his counsel, Adetunji Osho, to allow his appeal and set aside the decision of the tribunal.

The appellant insisted that the tribunal erred by ruling that the papers tendered by him were mere documentary hearsay.
According to Osho, the documents tendered showed that collation of results for the Benue South senatorial district’s election on March 28 was still ongoing in seven of the nine local government areas, when the Independent National Electoral Commission (INEC), declared Senator Mark winner of the poll.
