PDP vows to take action against Kano Speaker for refusing to swear-in its lawmaker

Peoples Democratic Party has called on Kano State government and the Attorney General of the Federation to urgently address what it called “lawless and barbaric display of impunity” by the leadership of Kano State House of Assembly.

The party was reacting to the refusal of the Speaker of the Assembly, to swear in a member of the PDP who was declared as the winner of the election into the Assembly to represent Kura/Garun Mallam constituency.

The PDP also vowed to take every legal means to ensure that the speaker pays for his actions in refusing to conform with the apex court’s order.

The Supreme Court had in a July 12, 2017 judgment, sacked an All Progressives Congress (APC) lawmaker, Hayatu Sallau representing the constituency in the House of Assembly.
The apex court judgment affirmed an earlier November 27, 2015, judgment of the Court of Appeal, which sacked Sallau.

In its judgment, the Supreme Court had ordered the Independent National Electoral Commission (INEC) to withdraw Sallau’s Certificate of Return and issue same to Abdullahi Mohammed of the PDP and that the Speaker of Kano Assembly should swear him in.

But following the refusal of the Speaker to carry out the order, the PDP in a statement by its spokesman Dayo Adeyeye on Sunday, said INEC had complied with the judgment by issuing a Certificate of Return to Abdullahi Mohammed. It wondered why the Speaker has refused to do same.

“From the judgment of the Supreme Court, it is clear that the Speaker of the Kano State House of Assembly is under obligation to swear in Abdullahi Muhammed of the PDP without delay. However, 26 days after the judgment, and more than two weeks after INEC issued his Certificate of Return, the Speaker is yet to comply with the court judgment.

“In a lawless and barbaric display of impunity, the Speaker has refused to swear in our candidate. We call on the governor of Kano State, federal attorney general, and well meaning Nigerians, to prevail on the Speaker of the Kano State House of Assembly to obey the rule of law and perform his constitutional duty by swearing in Abdullahi Mohammed without further delay.”

According to the PDP, all available legal means will be explored to ensure that the Speaker of the Kano House of Assembly is brought to book for violation of the constitution.
