SUSPENSION: Battle not over as Senate drags Omo-Agege to Appeal Court

The suspension saga between the Senate and the senator representing Delta Central senatorial district, Ovie Omo-Agege, is not yet over as the upper chamber of the National Assembly has dragged the matter to the Appeal Court.

The Senate is asking the appellant court to sack the ruling of the Abuja Federal High Court presided over by Nnamdi Dimgba, which on Thursday nullified the suspension of Omo-Agege.

The Senate and the Senate President Dr Bukola Saraki, a second defendant in the case, also filed for a stay of execution of the nullification of the suspension.

The court had nullified the suspension of Senator Omo-Agege and declared it illegal. It held that the Senate had the power to punish its members, but could not suspend a senator for more than 14 days.

Omo Agege, an All Progressives Congress (APC) senator from Delta State was suspended after he openly criticised the amendment of election sequence carried out by the senate and alleged that the move was targeted at President Muhammadu Buhari.

In its response to the allegation, the Senate had referred Omo-Agege to its Committee on Ethics, Privileges and Public Petitions for investigations, but the senator in turn sued the Senate and prayed the court to stop the committee from investigating him.

Unhappy with Omo-Agege’s court action, the committee recommended that he be suspended and he was slammed with 90 legislative days’ suspension.

The Senate on Thursday, soon after its action against Omo-Agege was nullified and declared illegal, announced that the Senate along with the Senate President, have filed a Notice of Appeal and a Motion for Stay of Execution of the same Judgment on May10, 2018.
